The Harness contracting entity for each of the Products is specified in the table below and is “Harness” for purposes of the relevant terms, the Agreement and any associated Orders.
Harness Inc. Products
Harness AI
1. Harness AI. Customer’s use of Harness AI is subject to the following additional terms.
1.1. Definitions
"Input" means any data or information provided by Customer or its users for processing by Harness AI.
“Harness AI” means the suite of generative artificial intelligence products or features made available through Harness Platform or Software as outlined on Harness AI’s website, in the Documentation, or in the applicable Order Form.
“Output” means any data or information generated and returned to Customer or its users by Harness AI based on the Input.
1.2. Customer Responsibilities.
1.2.1. Input and Output. Harness may use third party providers such as Open AI, Google, or others to provide the generative artificial intelligence for Harness AI in order to produce Output (collectively, the “Gen AI Providers”). Input and Output are Customer Data. Customer must ensure that its Input, Output, and use of Harness AI does not (i) violate any law; (ii) violate the Agreement or an applicable Order; or (iii) infringe, violate, or misappropriate any Harness or third-party rights. Customer acknowledges that due to the nature of machine learning and the technology powering Harness AI, Output may not be unique, and Harness AI may generate the same or similar output for third parties. Harness may process Input and Output to provide Harness AI and related support in accordance with the Agreement.
1.2.2. Restrictions. Customer must not use Harness AI: (i) to mislead any person that Output was solely human generated; (ii) in violation of the Harness Acceptable Use Policy located at https://www.harness.io/legal/aup, or (iii) in violation of OpenAI’s Usage Policy, or any other third party terms, guidelines, policies or the like to which Harness links in connection with the generation of Output.
1.3. Disclaimer. Harness does not make any warranty as to Harness AI, Output, the results that may be obtained from the use of Harness AI or the accuracy of any information obtained through Harness AI, including with respect to the factual accuracy of any Output or suitability for Customer’s use case. Use of any Output, material and/or data obtained through the use of any Harness AI feature is at Customer’s sole risk. Customer should not rely on any factual assertions in Output without independently fact checking their accuracy. No information or advice, whether oral or written, obtained by Customer from Harness or through Harness AI creates any such warranty.
1.4 Harness AI Indemnification. Subject to and limited to the scope of the indemnification provided by the Gen AI Provider to Harness under the agreement between Harness and the Gen AI Provider, Harness shall defend and indemnify Customer from and against all third party suits, claims, demands, penalties, reasonable costs and reasonable expenses that result directly from Harness AI or the Outputs (the “Indemnifiable Losses”), provided that if (i) Harness AI is provided at no cost to Customer, (ii) Customer has modified Harness AI or the Output, or used them in combination with any other products, applications, or processes; (iii) the Indemnifiable Losses are the result or arise out of Customer’s violation of the Agreement or the terms above; or (iv) Customer knew or should have known the Output was infringing, likely to infringe, or otherwise misappropriate a third party’s intellectual property rights, then Harness shall have no obligation to indemnify Customer under this Section 1.4.
Code Repository
1. Code Repository. Customer’s use of Code Repository is subject to the following additional terms.
1.1. Definitions
"Code Repository" means any use of the Harness provided git repositories and large file store within the Continuous Integration (CI) module.
“Bandwidth” means the sum total of data transferred to or from git repositories or large file store in Code Repository.
“Storage” means the sum total of data stored on disk in git repositories or large file storage in Code Repository.
1.2. Customer Responsibilities.
1.2.1. Bandwidth and Storage Limitations. Storage and Bandwidth are Customer Data. Customer must ensure that the amount of data in Storage or transferred in Bandwidth does not exceed the limitations set in the Harness Code Repository module usage limits. Customer may petition Harness for an increase in these limits on a paid plan. Usage limits on free plans will not be extended.
1.2.2. Excessive Storage and Bandwidth. If Harness determines that Customer’s actual Storage or Bandwidth exceeds the usage limits, Harness may suspend Customer’s account, throttle Customer’s file hosting, or otherwise limit Customer’s activity within the Harness Platform until Customer enters a paid plan. In connection with the use of a free tier of Code Repository, Harness further reserves the right—after providing advance notice—to delete repositories that Harness determines will place undue strain or burden on its infrastructure or the Harness Platform.
